Finding a home is a big step. Understanding the agreement is just as important. A few familiar German terms—and a careful handover—can help you budget properly and avoid disagreements later.

Cold rent is not your whole housing budget

Kaltmiete is the basic rent. Nebenkosten are agreed service charges, and Warmmiete generally combines basic rent with those charges, often including heating. Check the actual breakdown: electricity, internet and other services can still require separate contracts.

Where charges are paid as advances, an annual reconciliation can create a refund or an extra bill. A flat-rate arrangement works differently. Before signing, check what is included, how costs are calculated and whether the contract contains scheduled rent increases (Staffelmiete) or an inflation-linked rent (Indexmiete).

How much deposit can the landlord ask for?

For an ordinary residential tenancy, the security deposit is generally capped at three months of rent excluding separately stated service charges. If paid in cash, you are entitled to three equal monthly instalments: the first is due when the tenancy begins and the next two with the following rent payments.

The deposit must generally be held separately from the landlord’s own money. Agree and document the payment method. After you leave, return is not necessarily immediate: legitimate damage claims or outstanding charges may need to be assessed. Keep your evidence and seek advice if retention seems unreasonable.

The handover is worth doing carefully

Record existing defects, meter readings, the number of keys and the condition of rooms in an Übergabeprotokoll. Take dated photographs and keep an agreed copy. Raise important discrepancies before signing a statement that everything is undamaged.

Confirm who your contractual landlord is, especially for a sublet, and request the Wohnungsgeberbestätigung for address registration. Check promised furniture, appliances and repairs against the contract. If a clause about renovations, repairs or liability is unclear, ask for an explanation or qualified review before accepting it.

Check how—and when—you can leave

For a normal open-ended residential tenancy, the tenant’s notice is generally received by the third working day of a month to end the tenancy at the end of the month after next. In practice, plan for about three months. Residential termination normally requires signed written notice; a routine email or WhatsApp message is not enough.

A fixed term, an agreed minimum commitment and special accommodation can change the position. Moving abroad does not automatically remove your obligations. Check the actual contract, keep proof of receipt and obtain advice if the terms are uncertain.

Pause if the offer feels wrong

Be cautious about pressure to transfer money before you have verified the accommodation and the person entitled to rent it. An attractive listing, emailed passport copy or convincing-looking contract is not enough on its own. Independently check who you are dealing with, view the property where possible and question unusual payment or key-delivery arrangements.

Budget for the real monthly cost, not just the headline rent. Keep the listing, contract, correspondence and receipts together.
